Contest RulesELIGIBILITY
To play you must be eighteen (18) years of age
or older at date of registration and must have a valid email address
and Internet access. No cost of registration. This game is open only to legal residents of all fifty (50) United States and the District of Columbia and all provinces of Canada with the exception of Quebec. Residents of Puerto Rico are also not eligible.
Persons residing in any other jurisdictions may enter (unless this
contest or entry into this contest is restricted or prohibited by
applicable local law), but will not be eligible to win any prizes. All
federal, state and local laws and regulations apply. Void where
restricted or prohibited. Contest begins Thursday,
May 15, and ends when the final heat of the Little Brown Jug 2008 is declared official.
NO PURCHASE NECESSARY TO WIN OR PARTICIPATE.
Buying will not help you win. Your chances of winning without making a
purchase are the same as the chances of someone who purchases something.
Employees of Horseman Publishing Company, the
Delaware (Ohio) County Fair, and their respective affiliates,
subsidiaries, vendors, contractors, directors, advertising agencies,
racing officials and their respective immediate family members or those
living in the same household of such individuals may participate but
are NOT ELIGIBLE TO WIN. All federal, state and local laws and
regulations apply.
GENERAL CONDITIONS
This contest is governed by the applicable laws
of the United States. All federal, state, provincial and local laws and
regulations apply. By entering, participants agree to release,
indemnify and hold harmless Horseman Publishing Company, the Delaware
(Ohio) County Fair, and their sponsors, respective parents,
subsidiaries, affiliates, directors, officers, employees and agents
from any and all liability for any injuries, loss or damage of any kind
arising from or in connection with the contest or any prize won.
CONDUCT
The Official Rules are posted on the
Little Brown Jug fantasy stable site, www.JugBarn.com. By entering this
contest, you agree to be bound by these official rules and the
decisions of Horseman Publishing Company and the Delaware (Ohio) County
Fair and their sponsors, which shall be final and binding in all
respects.
Horseman Publishing Company and the Delaware
(Ohio) County Fair and their vendors, sponsors and partners reserve the
right to, at their sole discretion, disqualify any individual that:
tampers or attempts to tamper with the entry process or the operation
of the contest or Web site; violates the "Official Rules;" or acts in
any unsportsmanlike, rude, or disruptive manner, or with intent to
annoy, abuse, threaten or harass any other person. Horseman Publishing
Company and the Delaware (Ohio) County Fair reserve the right to
terminate or modify this contest at any time. Note: User names must not
violate any intellectual property infringement or cause defamation;
profanity or other objectionable language or names could result in
disqualification at the discretion of Horseman Publishing Company and
the Delaware (Ohio) County Fair.
WARNING--Any attempt by an entrant or
individual to deliberately damage any Web site or undermine the
legitimate operation of the contest is a violation of criminal and
civil laws. Should such an attempt be made, Horseman Publishing Company
and the Delaware (Ohio) County Fair reserve the right to seek damages
from any such person to the fullest extent permitted by law.
NOTIFICATION
Winners will be notified by e-mail, regular
mail or telephone within seven (7) days after the date the winners are
determined. Winners may be required to sign and return an affidavit of
eligibility and acceptance of these "Official Rules" and a
publicity/liability release (unless prohibited by law) within fifteen
(15) days following attempted notification.
By accepting any prize, the winner (and, if
applicable, companion) grant permission to Horseman Publishing Company
and the Delaware (Ohio) County Fair to use their names and/or
likenesses for publicity and promotional purposes without further
compensation, unless prohibited by law, and agree to execute a written
consent. Prizes not confirmed by Nov. 30, 2008, may be forfeited
or voided.
In the event of a dispute about the identity of
any entrant, entries made online will be declared made by the
authorized account holder of the e-mail address submitted at time of
entry. "Authorized account holder" is defined as the person who is
assigned to an e-mail address by an Internet access provider, online
service provider or other organization that is responsible for
assigning e-mail addresses for the domain associated with the submitted
e-mail address. A potential winner may be required to provide Horseman
Publishing Company and the Delaware (Ohio) County Fair with proof of
identity, and proof that the potential winner is the authorized account
holder of the e-mail address associated with the winning entry. Prizes not confirmed by Nov. 30, 2008, may be forfeited or voided.
ENTRY
To enter the contest, go to www.jugbarn.com and
complete the electronic registration form. No faxed, mailed,
electronically mailed, or phoned-in entries are allowed; this is an
Internet-based game only.
ENTRY LIMIT & ADDRESS CHANGES
One entry per person; the information you enter
into each of the fields of the electronic registration form must be
unique. Duplicate entries are cause for disqualification of all
involved entrants and stables, and are made at the sole discretion of
Horseman Publishing Company.
It is the sole responsibility of the entrant to
notify Horseman Publishing Company by e-mailing any changes to:
jugbarn@harnessracing.com. Horseman Publishing Company and the Delaware
(Ohio) County Fair, their sponsor(s), vendors(s) and partner(s) assume
no responsibility for lost, late, misdirected, illegible or mutilated
entries. Horseman Publishing Company, the Delaware (Ohio) County Fair
and their sponsor(s), vendor(s) and partner(s) are not responsible for
lost, interrupted or unavailable hardware or software or telephone
transmission or technical failures, garbled or jumbled transmission or
other error of any kind, whether human, mechanical or electronic. In
the event the Little Brown Jug is not raced due to any reason
whatsoever, the contest is null and void.
Once submitted, entries and correspondence
become the sole property of Horseman Publishing Company and the
Delaware (Ohio) County Fair and will not be returned.
WINNER SELECTION
This is a game of skill. Winners will be determined by the objective criteria set forth on the "Contest Scoring"
page. From all eligible entries received, the winners will be the
players who accumulate the most points during the Little Brown Jug
Fantasy Stable Challenge contest, according to these "Official Rules."
Odds of winning depend on the number of
eligible registrations received and skill level of each entrant. In the
event of a tie between two or more eligible entrants, the winner will
be the entrant that receives the most points using the following
tiebreakers, in order of sequence: winning driver, winning trainer. In
the event a tie situation still exists, the winning entry will be
awarded from a blind draw.
The halfway mark of the contest is after the Meadowlands Pace final has been completed. Those point leaders will receive notification within seven (7) days after the Meadowlands Pace final. In the event the Meadowlands Pace final is not raced for any reason whatsoever, the “Leaders at the Halfway Mark” contest is null and void. Winners will be determined before 12:00 pm EDT, Sept. 26, 2008. Winning entries must confirm residence and eligibility to receive prizes. Any winners unconfirmed by Nov. 30, 2008, forfeit their prizes.
